New Delhi/ Ludhiana: Dr. Assa Singh, 96, was reportedly granted bail by the Supreme Court of India on 17 October, 2014. Bapu Assa Singh was convicted by a TADA court in November 2012 in a more than 25 years old case.
The case: FIR No. 26, dated 12-02-1987, under sections 120B, 342, 395, 397, 412, 506 IPC 1860; u/s 25 and 27 Arms Act 1959 and u/s. 3, 4, 6 & Rule 18 of TADA(P) Act 1985 at Police Station Division No. 6 Ludhiana, was CBI case no. RC/1/87-SIU-II, dated 17-02-1987.
On November 20, 2012 a designated TADA court convicted him under Terrorist and Disruptive Activities (Prevention) Act (TADA) for recovery of cash shown against him by the prosecution and sentenced him to undergo 10 years of imprisonment.
From his day of conviction Bapu Assa Singh was serving the sentence in Central Jail, Hoshiarpur. His appeal was moved in the Supreme Court of India with in legal time frame, but it still remains pending for hearing. The Supreme Court of India took long time to decide his bail plea.
Advocate Jaspal Singh Manjhpur told Sikh Siyasat News (SSN) over phone that it may take some days for Bapu Assa Singh to come out as release on bail requires significant amount of paper work.
It is significant to note that TADA ceased to be operative since May 1995 as the Indian State did not dare to renew it because of massive opposition as this law was being widely misused. He was sentenced under TADA 17 years after it’s expiry.
