Amritsar TADA court hears arguments on bail plea of Prof. Devender Pal Singh Bhullar

Amritsar: Sikh political prisoner Prof. Devender Pal Singh Bhullar was presented in a designated TADA court Amritsar today in a 23 years old case.

Prof. DPS Bhullar’s counsel Advo. Jaspal Singh Manjhpur told Sikh Siyasat News (SSN) that Prof. Bhullar was presented before Surinder Singh Sahni, designated TADA judge (Amritsar), in relation to a case registered at Sadar Batala police station in 1992.

Advocate Jaspal Singh Manjhpur said that the court heard the arguments in a revision petition filed against lower court’s decision to deny bail to Prof. Devender Pal Singh Bhullar. He said that a bail plea was moved before a lower court in Gurdaspur (as this case relates to Batala, which falls under Gurdaspur district) under section 167 (2) of Code of Criminal Procedure.

“We based our argument on a mainly ‘question of law’ that the lower court had denied our rightful right to seek bail as the police had failed to present the chargesheet in this case with the time period specified by law. Section 167 (2) grants a right to seek bail in such cases”, Advo. Manjhpur said.

The court has heard the arguments and the decision will be pronounced on March 3, he added.

Prof. Bhullar’s counsel also told SSN that the case, wide FIR no. 233/92, was registered under sections 3, 4 and 5 of TADA, sec. 307 of IPC and secs. 4 and 5 of Explosives Act at Batala police station” said Advocate JS Manjhpur.

Meanwhile a report on metal health condition of Prof. Devender Pal Singh Bhullar was also presented in the court by Dr. PD Garg, incharge of Prof. Bhullar’s case at Psychiatry Ward of Guru Nanak Hospital, Amritsar. Dr. PD Garg opined in his report that Prof. Devender Pal Singh Bhullar is capable of understanding the proceedings of the court and he can stand on trial in this case.

Advocate JS Manjhpur told SSN that Prof. Devender Pal Singh Bhullar was present in court during today’s proceedings. The court had directed the police to not to present Prof. Bhullar on March 3 as on that day the court would only pronounce it’s decision on matters already argued upon.
