Bhai Daljit Singh charged under UA(P)A – sent on 5 days police remand; Panch Pardhani Office sealed

Ludhiana/Punjab (September 21, 2012): According to latest information Ludhiana Police produced Bhai Daljit Singh Bittu former President of Akali Dal Panch Pardhani in Chief Judicial Magistrate (CJM) Mr. Asis Thathai’s court levelling allegations of serious offences against him and demanded police remand for ten days. CJM has sent Bhai Daljit Singh on five days police remand.

Police has registered F.I.R. No. 183 dated September 21, 2012 against Bhai Kulbir Singh under Indian Penal Code Sections 120-B (Criminal Conspiracy), 121 (Waging War against the State), 121A (Conspiracy to Wage War against the State; Sections 25, 54, 59 and 25A of Arms Act; Sections 3, 4, and 5 of Explosive Act and Sections 17, 18, 18A, 19, 20, 38, 39, 40 of Unlawful Activities (Prevention) Act.

It is notable that in a separate FIR no. 137/12 registered at Goraya Police has registered a case Bhai Kulbir Singh Barapind President of Akali Dal Panch Pardhani under same sections.

It is notable that a police party today raided the Gurdev Nagar Ludhiana based resident of Bhai Daljit Singh this morning and searched the house for more than six hours. Police has seized two personal computers, books and other documents. Police informed that court that it has seized papers/documents in five bags.

Similer raid was conducted by police in Maharaj Nagar, Ludhiana based office of Akali Dal Panch Pardhani and according to information police has sealed the entire building of ADPP office.

Bhai Daljit Singh Bittu’s councils Advocate Harpal Singh Cheema, Advocate Jaspal Singh Manjhpur and Advocate Gurmeet Singh Rattu appeared in the court and opposed the remand demanded by the police. Advocate Jaspal Singh Manjhpur argued that in the FIR the police has accused Bhai Daljit Singh for offences under Arms Act and Explosives Acts without any recovery, and at the same time police has already sealed the ADPP office. So in this situation police could easily plant any recovery against Bhai Daljit Singh. He requested the court to take the note of these facts. Upon court query the police admitted that it has sealed the ADPP office and it’s keys are with the police and CJM took a noting of this fact on court records.

Police demanded ten days police remand which was strongly opposed by Bhai Daljit Singh’s councils but CJM sent Bhai Daljit Singh on five days police remand.

It is notable that Police has levelled similar allegations against Bhai Daljit Singh that, earlier today, were levelled by Goraya Police against Bhai Bhai Kulbir Singh Barapind including allegations of links with Babbar Khalsa International (BKI) and Pakistan, allegations regarding funds etc.

It is notable that Unlawful Activities (Prevention) Act, 1967 was amended on December 31, 2008 by the Indian Parliament, soon after the 26/11 Mumbai Attacks. According to Human Rights organizations and legal experts these amendments were aimed at making UA(P)A – a replacement of notorious TADA and POTA laws, that were repealed thorough abuse.

Many Human Rights Organizations have alleged from time to time, since the amendments that UA(P)A is being abused to crush the political dissent.
