Defence lawyer seeks discharge of Prof. Devender Pal Singh Bhullar in Batala TADA case

Amritsar: Sikh Political Prisoner Prof. Devender Pal Singh Bhullar was presented before a TADA court in Amritsar today. The court heard arguments of prosecution and defence on chargesheet moved by the police against Prof. Devender Pal Singh Bhullar in this case.

“We have argued in the court that there was no basis for trying Prof. Devender Pal Singh Bhullar in this case. Whole police chargesheet speaks for a clearly fabricated case” said Advocate Jaspal Singh Manjhpur, counsel of Prof. DPS Bhullar.

He said that the case documents (copy available with the Sikh Siyasat News) reveal that the case pertains to an alleged police encounter in which two Sikhs were shot dead by the Batala police. They were identified as Gurmej Singh alias Geja and Joga Singh, both residents of Vero Nangal village.

A case under Section 307, 34 of the IPC and 25, 54, 59 of the Arms Act, 3, 4, 5 of TADA and 4, 5 of the Explosive Act was registered at Sadar police station in Batala in 1992.

Prof. Devender Pal Singh Bhullar was named in the case in February 1995. He was under the custody of Delhi police at that time. There is no direct evidence or witness against Prof. Bhullar. According to police file a person had disclosed before the police that ‘Sikh militants’ used to visit his house to take meals and on the day of 1992 incident (related to the present case) Prof. DPS Bhullar had visited his house. On the basis of this statement the police has named Prof. Bhullar in this case.

Prof. Bhullar, who is presently admitted in psychiatry ward of Guru Nanak Hospital in Amritsar was presented before the designated TADA court of Justice Surinder Singh Sahni on February 26. The court had also asked the police and medical authorities to submit a report whether he was fit to face trial and had fixed the date of hearing on March 1.

On March 1 Dr PD Garg had submitted his report saying that Prof. Bhullar’s condition has partially improved and he could understand the trial proceedings.
