New Delhi, India (May 31, 2014): According to information available with the Sikh Siyasat News (SSN) Indian politician and Sikh genocide 1984 accused Jagdish Tytler appeared in the court of Gaurav Rao Additional Chief Metropolitan Magistrate Patiala house New Delhi today in the case filed by Senior Advocate H S Phoolka regarding to defamatory allegations and threat to kill made by Jagdish Tytler against Mr Phoolka during live TV interview. This fight between Jagdish Tytler and H S Phoolka during a TV interview is widely circulated on the net and You Tube.
Mr Phoolka had filed a Criminal complaint against Tytler at Ludhaiana. The Magistrate in Ludhiana court issued warrant against Jagdish Tytler, Later Jagdish Tytler filed petition in Supreme court for transfer the case to Delhi alleging that he cannot go to Ludhiana due to threat and also that he does not expect a fair trail at Ludhiana.
The Supreme Court transferred the case to Delhi. Today Tytler appeared in the court of Gaurav Rao (ACMM) pursuant to the directions of the court for him to appear. The arguments were heard by the court on the issue whether to proceed the case only for defamation or also regarding the threat to kill attracting 506 IPC and accordingly follow the procedure for warrant cases. After hearing the arguments the court reserved the order for 2 July 2014 and directed Tytler to appear on that day also.
During the course of hearing the Judge on suggestion of lawyer of Tytler asked Mr Phoolka if Tytler tenders public apology, then if Phoolka is prepared to withdraw the case. Phoolka declined to accept the public apology stating that the roots of this case emerges from the largest massacre in the history of independent India and Phoolka was doing only his duty as a lawyer to ensure the punishment for guilty. Tytler being a Cabinet Minister at that time threatened him. He further stated that it is a matter of immense public importance and hence no question of acceptance public apology or withdrawal of the case.
Phoolka later said to media that he would fight this case as well as other case of genocide till the end.
