Judge Refuses to Accept Chargesheet against Bhai Jagtar Singh Hawara in His Absence

Ludhiana/ Moga: A local court in Nihal Singh Wara (Moga) today refused to accept chargesheet against Sikh political prisoner Bhai Jagtar Singh Hawara in his absence.

This case was registered on 18 February, 2005 under FIR 10/2005 registered at police station (PS) Badhni Kalan u/s 307, 323, 183, 353, 120-B (Indian Penal Code) and section 25 of Arms Act.

Bhai Jagtar Singh Hawara is confined in Delhi’s Tihar Jail. On 13 July, 2017 the court had allowed the police to arrest Bhai Jagtar Singh Hawara in this case without bringing him out of the Tihar jail as the police. “The police belonging to Badhni Kalan police station visited Tihar jail on 24 July, 2017 and  formally arrested Bhai Jagtar Singh Hawara there”, said Advo. Jaspal Singh Manjhpur.

“I was informed by the concerned SHO that the police would present chargesheet in this case today so I went to Nihal Singh Wala. The Punjab police had presented a chargesheet against Bhai Jagtar Singh Hawara before the court Pankaj Verma, Sub-Divisional Judicial Magistrate, Nihal Singh Wala (Moga) but the judge declines to accept that chargesheet as Bhai Jagtar Singh Hawara was not present in the court”, he added.

“After the judge refused to accept the chargesheet, the police withdrew it. It is expected that the police will present the chargesheet in this case on some future date”, he added.
