Burail Jailbreak case: Police appeal against bail order; Says charges of Waging War still stand against Jagtar Singh Tara

Chandigarh/ Punjab: Chandigarh police has reportedly moved an appeal against bail granted to Bhai Jagtar Singh Tara in Burail jailbreak case. It is notable that The Chandigarh police had urged the court to grant police custody of Bhai Jagtar Singh Tara in Burail jail break case. As the case pertained to a “bailable offence”, the court rejected the remand plea of UT police and granted bail to Bhai Jagtar Singh Tara in this case.

Relying on the order of additional district and sessions judge, Balbir Singh, in April 2005, judicial magistrate Harpreet Kaur on Monday (Feb. 16) denied the police an opportunity to interrogate Tara and also dropped all offences – related to waging a war against the country – against him.

The UT police, in it’s appeal moved before additional district and sessions judge Shalini S Nagpal on Saturday (Feb. 21), has challenged dismissal of UT police’s application seeking custodial interrogation. The Chandigarh police has maintained, in it’s appeal, that the FIR against Jagtar Singh Tara in the Burail jail break case still stands under sections of waging war against the state.

The court has now issued notice to Bhai Jagtar Singh Tara through his counsel AS Chahal for February 23 when the latter would file a reply to the appeal.
