DSGMC officials write to Indian PMO seeking Special public prosecutor for Nov. 1984 cases

New Delhi, India: A written statement (Sept. 25) by Delhi Sikh Gurdwara Prabhandak Committee (DSGMC) says DSGMC president Majit Singh GK and General Secretary Manjinder Singh Sirsa have written a letter to Indian prime minister Narendra Modi’s office demanding appointment of special public prosecutor to peruse cases related to November 1984 Sikh genocide.

DSGMC officials, in their letter, said that the Congress party led governments in India provided shelter to the accused persons and created hurdles in the path of justice. The letter says that despite the orders of a local court in 1992 the Delhi police did not present chargesheet against Congress party leader Sajjan Kumar in F.I.R number 67/1987 registered under police station Nangloi. The letter further says that in 2010 the court had appointed Advocate B. S. Joon as special public prosecutor in this case but instead of presening chargesheet the police re-started investigations in this case.

While making mention of another case (Delhi Cant. Case) DSGMC officials said that in October 2005 Delhi Cant. Case was transferred to CBI along with all relevant papers. Two months thereafter, Delhi Police filed a closure report in the Court giving clean chit to Sajjan Kumar. The Delhi High Court passed strictures against Delhi Police observing that once the case has been transferred to CBI, Delhi Police has no power to file closure report. The Delhi High Court directed the Commissioner of Police to hold inquiry and take action against guilty police officers within six months but till date no action has been taken by the Delhi Police.

The DSGMC letter further says that the DIG of CBI took a decision to file a charge-sheet against Jagdish Tytler. The said decision was approved by the then Joint Director, Mr. Arun Kumar. However, the then Joint Director, CBI Mr. Ashwani Kumar overruled this decision and decided to file the closure report giving clean chit to Jagdish Tytler. Mr. Ashwani Kumar has been awarded with a plum post of Governor of Nagaland.

While mentioning another case, the DSGMC officials said: [o]ne Mr. Joginder Singh, who is a Bus driver and a witness to one of the important cases, lost his son who was set on fire sleeping outside his house. His minor daughter was kidnapped about 12 years ago and till date has not been traced.

“These are some of the cases, which are known to the applicant and there are thousands more, which have never seen the light of the day on account of apathy and callousness of the previous government” says the letter.

DSGMC general secretary said that the PMO has agreed to consider the plea favorably.

Sikh Genocide 1984, Indian State and the JUSTICE:

It is notable that in November 1984 Sikhs were subjected to genocidal massacres throughout India. In Delhi alone more than four thousands Sikhs were brutally massacred and were burnt alive. Successive governments in India as well as the Indian judicial system have suffered deliberate failure to punish the guilt and impart justice to the victims. As DSGMC is controlled by Shiromani Akali Dal (Badal) – an ally to the ruling BJP, the DSGMC and SAD (Badal) leaders are saying that this time the BJP government would secure justice for the victims of November 1984. But it must be said here that whole Indian state system, including all it’s colors and forms (organs and political parties) has turned blind eye to the plight of victims of Sikh genocide; that’s why even many victims have left the hope of getting justice from the Indian state.
