Delhi High Court reserved verdict on Sajjan Kumar’s plea in 1984 Sikh massacre case

New Delhi, India (December 23, 2012): The Delhi High Court has reportedly reserved its order on December 21, 2012 on the plea of Congress leader Sajjan Kumar against a trial court order framing charges against him in the 1984 genocidal violence case.

“The order is reserved,” Justice Suresh Kait reportedly said after advocate H. S. Phoolka, counsel for complainant Sheela Kaur, concluded the arguments. Co-accused Ved Prakash Pial and Brahmanand Gupta had also moved the High Court against framing of charges against them in the case.
It is learnt that Sajjan Kumar, a Congress Party leader who is facing charges of murder and other offences in 1984 violence related cases, had challenged the framing of charges against him by a trial court. He has been facing charges of rioting in areas falling under Police Station- Sultanpuri and a case was registered against him on the recommendation of Nanavati Commission.
The Trial Court had framed the charges against the Sajjan Kumar and 5 other accused in July 2010. Subsequently Sajjan Kumar challenged the framing of charges before Delhi High Court.
While concluding the arguments Advocate Phoolka quoted the extract from the Report of Mishra Commission where the co-accused involved with Sajjan Kumar had committed the gang-rape of a girl and killed 9 members of her family – her father, brother, grand-father, chacha, mama and their children in Sultanpuri area itself. Advocate Phoolka argued that these offences were committed by same mob led by Sajjan Kumar.
It is further learnt that Advocate Phoolka further argued that the trend of gang-rape is not started today, it started in 1984 and the guilty were not punished even the cases were not registered against them. He argued that most shocking part is that these rapists and murderers were given rewards and given high positions.
