After 30 years of 1984 Sikh genocide – SCI suspects that accused trying to stall trial proceedings

New Delhi, India (October 02, 2013): It is learnt that the Supreme Court of India (SCI) on Monday (September 01, 2013) said the accused in the November 1984 Sikh massacres related case, including Congress leader Sajjan Kumar, are trying to stall the proceedings in the trial court by approaching higher courts at every stage. However, while saying so, the court agreed to hear their plea for quashing the charges of murder and rioting in the killing of six persons during the 1984 carnage.
As per media reports a bench headed by Justice A.K. Patinaik said: “You are stalling the proceeding at every stage. Please do not stall the proceedings”.
The bench accepted to hear the plea of Sajjan Kumar, Brahmanand Gupta and other accused after their lawyer submitted that the trial court and the Delhi high court committed an error by dismissing their plea for quashing charges. The bench, after a brief hearing, adjourned the case and posted it for hearing on October 4.
Dismissing the plea of Kumar, the high court had affirmed the trial court’s order saying charges could be framed if there is a strong suspicion leading the court to think that there is ground for presuming that the accused has committed the offence.
The high court, however, refused to frame the additional charge of conspiracy against him and co-accused Ved Prakash Pial and Brahmanand Gupta.
It is notable that the Indian judiciary has drastically failed to hold trials against the culprits for the accused of Sikh genocide 1984 for last three decades. State-patronage to the accused has worked as a strong shield for the accused against any sort of proceedings for crimes committed by them. In April 2013 an Indian court dramatically acquitted Indian politician Sajjan Kumar in a November 1984 Sikh massacre related case despite direct evidence against him.
