Delhi court summons Congress leader Jagdish Tytler in Defamation case filed by HS Phoolka

New Delhi, India (February 19, 2014): As per information Congress leader and an accused in cases relating to 1984 Sikh massacre, Jagdish Tytler has been summoned by Patiala House Court in a criminal case of defamation filed by Supreme Court Lawyer Harvinder Singh Phoolka, who recently joined Aam Aadmi Party (AAP).

Orders to summon Tytler were passed on February 19 by Additional Chief Metropolit an Magistrate Gaurav Rao.

It is learnt that Jagdish Tytler has been directed to appear in the Court on 31st of May for framing of charges against him.

The case was filed by H.S. Phoolka against Tytler in District Court, Ludhiana which was subsequently transferred by Supreme Court to Delhi.

Ms Kamna Vohra, Advocate appeared for H. S. Phoolka in the court.

Advocate Harvinder Singh Phoolka reportedly told some media sections that Jagdish Tytler had appeared only once in the court as the court had granted him exemption from personal appearance. However, he has now been summoned and directed to be personally present in the case for framing of notice.

It may be recalled that Advocate Phoolka had alleged that Jagdish Tytler made derogatory remarks against him in a news programme aired on an India level news channel on September 7, 2004.

“False and derogatory allegations levelled by Jagdish Tytler against me have harmed my reputation in the society”, HS Phoolka reportedly had told the court.

It is also pertinent to mention here that HS Phoolka’s complaint also requested the court to prosecute Tytler for the alleged offence of criminal intimidation.

The case originally filed at Ludhiana was transferred to Delhi on the orders of Supreme Court of India (SCI) after Jagdish Tytler requested the SCI to transfer the same from Ludhiana in view of his security.
