Delhi Massacre 1984: Sajjan Kumar alleges political reasons behind his trial – Facts speak otherwise

New Delhi (August 14, 2012): In his final arguments in a criminal case related to Nvoember 1984 Massacre of Sikhs in Delhi before a trial court in Delhi the Congress leader Sajjan Kumar on August 13, 2012 blamed his “political opponents” for implicating him in the case.

As per reports in media Sajjan Kumar’s counsel I. U. Khan told trial court that his rivals constituted the G.T. Nanavati Commission to probe the 1984 violence cases for framing him.

“Political opponents of Sajjan Kumar got an opportunity to frame him in a false case by appointing the G.T. Nanavati Commission,” said Sajjan Kumar’s counsel.

The court was hearing a case against the Congress leader and five others accused of inciting mobs against the Sikhs during the incidents of genocidal violence against Sikhs.

The case against Sajjan Kumar was lodged on the recommendations of the Nanavati Commission. In January 2010, the Central Bureau of India filed two charge-sheets against him and others.

Sajjan Kumar is accused of instigating a mob to attack and kill Sikhs after the assassination of then prime minister Indira Gandhi October 31, 1984.

Sajjan Kumar and five others are facing charges under sections 302 (murder), 395 (dacoity), 427 (mischief to cause damage to property), 153-A (promoting enmity between different communities) and other provisions of the Indian Penal Code.

It is notable that Sikhs were massacred in November 1984 throughout India after the assassination of then PM of India, Indira Gandhi. The state participation is widely alleged in this case.

“A fact-finding team jointly organised by one People’s Union for Democratic Rights (PUDR) and people’s Union for Civil Liberties (PUCL) in the course of investigations from November 1 to November 10, has come to the conclusion that the attacks on members of the Sikh Community in Delhi and its suburbs during the period, far from being a spontaneous expression of “madness” and of popular “grief and anger” at Mrs. Gandhi’s assassination as made out to be by the authorities, were the outcome of a well organised plan marked by acts of both deliberate commissions and omissions by important politicians of the Congress (I) at the top and by authorities in the administration” reads “Who are the Guilty”, a report published soon after the massacre by civil rights bodies – People’s Union for Democratic Rights (PUDR) and People’s Union for Civil Liberties (PUCL).

It is notable that Sajjan Kumar’s name had also figured in “Who are guilty?” report by PUCL and PUDR. His name was listed in “List of people identified by Survivors” – a list of those alleged to have instigated violence and/or protected alleged criminals.

“Sajjan Kumar, Cong. (I) M.P. from Mangolpuri. Reported to have paid Rs. 100 and a bottle of liquor to each person involved in the killing” Annexure IV, List of “Who are guilty?”.

Moreover there are many eye-witnesses against Sajjan Kumar.
