New Delhi: The court of ACMM Ms Jyoti Kler today granted regular bail to two Sikh hijackers namely Satnam Singh and Tejinder Pal Singh in a 36 years old hijacking case. The fresh trail under sedition charges will begin from July 31.
Senior Advocate Mohit Mathur and Manisha Bhandari represented the accused in the court.
Both the lawyers argued before the Court that Satnam Singh and Tejinder Singh have already undergone lot of pain and torture in life. They have been tried once, convicted and sentenced. Moreover the Delhi court had discharged Satnam Singh and now they are being tried based on photocopy documents as the court records have already been destroyed.
Advocate Manisha while talking with media said the Court understood their plight and has granted them regular bail as of now. She said we will present our case before the Court when the time comes.
Pertinently the Delhi police have filed a supplementary challan (fresh charge sheet) in Delhi court on 29 Sep 2011 under sedition charges.
Accompanied the accused Dal Khalsa spokesperson Kanwar Pal Singh said the Indian state continues to hold anti-Sikh mindset. This case is classic example of how badly the state treats its minorities. Commenting on bail, he said its part relief and part fresh agony. The justice system has put them on fresh trial under after 36 years under “sedition charges”, ignoring their life imprisonment in Pakistan for the same offence.
He said since hijacking is a one – piece act, a fresh case under different offences amounts to violation of principle of double jeopardy and Geneva Convention.
The supplementary challan by the Delhi police under sections 121 (waging war against Government of India), 121A (conspiring to commit certain offences against the state), 124A (sedition) and 120B (criminal conspiracy) of the Indian Penal Code is clear case of afterthought.
It is pertinent to mention that Flight IC-423 was hijacked on September 29, 1981, to the Pakistan city after it took off from Delhi for Srinagar via Amritsar. The hijackers associated with Dal Khalsa demanded the release of Sikh preacher and head of Damdami Taksal Sant Jarnail Singh Bhindrawale who was arrested on Sep 20 the same year in a murder case.
