Lawsuit against Parkash S. Badal: Punjab govt’s legal team leaves for United States

Chandigarh/Punjab (August 25, 2012): Punjab Chief Minister Parkash Singh Badal who is facing a Human Rights Law suit in United States has returned from his foreign trip whereas Punjab has dispatched a legal team comprising of Ashok Aggarwal, Advocate General of Punjab and S. K. Sandhu an IAS Officer, who is Principal Secretary to Chief Minister to study and discuss the case with legal experts in US.

Now it is claimed claimed that no summons were served on the Chief Minister during his visit to United States of America earlier this month.

According to information available with “Sikh Siyasat” the lawsuit filed by a human rights organization named ‘Sikhs for Justice’ (SFJ) and another plaintiff Avtar Singh, a member of Shiromani Akali Dal Amritsar (led by Simranjit Singh Mann) is listed for 30th of August when the Chief Minister, as defendant has to file his reply.

“The sources in the government claim that as claimed and reported, no summons were served on the Chief Minister during his visit to US” reports “YesPunjab” (YP).

“It is pertinent to mention here that SFJ had claimed that the summons were served on Badal when he visited a School at Oak Creek to comfort the families of the victims of August 5 Oak Creek shoot-out” YP reports further.

It is notable that the United States Federal Court for the Eastern District of Wisconsin had issued summons against Badal on a complaint filed by plaintiffs.

Plaintiff Avtar Singh had alleged in the lawsuit that Badal had shielded police officials who inflicted custodial torture and were responsible for the extra judicial killings and continuous human rights violations against the Sikhs in Punjab.

It had claimed that the federal court has jurisdiction under the Torture Victim Protection and Alien Tort laws, and because Badal is currently in Wisconsin.

The court had given Badal, 21 days to answer the charges. The lawsuit against Badal seeks jury trial.
