NIA Plea Seeking Jail Transfer of Jagtar Singh Jaggi and Others Dismissed by Special NIA Court

Mohali: The Special NIA Court of Mohali’s Additional Sessions Judge I (Mohali) today dismissed National Investigation Agency (NIA)’s plea seeking jail transfer of arrested Scottish citizen Jagtar Singh Jaggi, Taljit Singh @ Jimmy Singh, Ramandeep Singh Bagga and Hardeep Singh Shera to Tihar jail.

Defence council Advocate Jaspal Singh Manjhpur told Sikh Siyasat News (SSN) over phone that the court of Ms. Anshul Berry today pronounced the decision dismissing NIA’s plea.

The court had heard arguments on NIA’s plea yesterday after which the verdict was reserved for day. Advocate Barjinder Singh Sodhi and Advocate Jaspal Singh Manjhpur had opposed the NIA’s plea in the court yesterday.

Advocate Jaspal Singh Manjhpur said that the NIA’s plea was not maintainable as there is no law or rule under which an undertrial could be transferred out to some other state.

“We had appraised the court that the NIA court lacks jurisdiction to entertain any such plea seeking transfer of Jaggi and others to Tihar Jail in New Delhi. Moreover, the NIA was not able to cite any law or rule supporting their plea”, he said while adding that the defense had cited Supreme Court’s rulings to containing that case law on matters related to jail transfers which clearly says that no government or trial court could order transfer of an accused person to some outside state.

“The court has appreciated our arguments and the plea was dismissed today”, added he.

It is notable that NIA had procured a notification from the Indian Home Ministry to support their plea and even Punjab government led by Capt. Amarinder Singh and Delhi Government led by Arvind Kejriwal had also given “no objection” to jail transfer.
