Jalandhar (October 25, 2012): It is learnt that the Jalandhar Police, Kapurthala jail authorities, Chief Medical Officer (CMO, Civil Hospital) Jalandhar have failed to get Bhai Kulvir Singh Barapind examined by a medical board despite court’s order in this regard. On September 28, 2012 the Phillaur court has directed the CMO, Civil Hospital, Jalandhar to constitute a board for medical examination of Kulbir Singh Barapind, who had alleged torture in police custody. Bhai Kulvir Singh Barapind is President of Akali Dal Panch Pardhani, a political party holding dissenting views and ideology, that seeks to ensure proper political status for the Sikhs nation in India.
It is learnt that on October 22, 2012 the lawyer of Kulvir Singh Barapind filed an application in the court to seek legal action against the officials concerned.
“On September 25, 2012 Bhai Kulvir Singh Barapind complained in the court of judicial magistrate first class Jatinder Pal Singh that during his police remand he was tortured by the police by applying electric shocks and demanded his medical examination,” advocate of Advocate Harpal Singh Cheema told Sikh Siyasat News over phone.
Acting on the complaint, the court on September 28, 2012 had directed the chief medical officer (CMO) of the civil hospital, Jalandhar, to constitute a medical board for medical examination of Kulvir Singh Barapind. The copy of order is available with Sikh Siyasat News.
In this order the court had also issued direction to the jail superintendent of Kapurthala to do the needful for medical examination of Kulvir Singh Barapind as per rules and even ordered to ensure the compliance of the order.
Despite the fact that more than 20 days have passed, nothing has been done regarding the constitution of the medical board, Advocate Cheema added.
“The prosecution/inquiry officer has not complied with the order passed by the court intentionally as the prosecution was in knowledge that the applicant was tortured by way of applying electric shocks,” Barapind’s lawyer Advocate Kashmir Singh Malhi, in his application to the court, stated, urging the court to take appropriate action against the prosecution, inquiry officer, superintendent of central jail, Kapurthala, and CMO of the civil hospital, Jalandhar, in the interest of justice.
The court has fixed the matter for hearing on October 30,2012 but no order for conducting medical was passed afresh.
Bhai Harpal Singh Cheema, acting president of Akali Dal Panch Pardhani told Sikh Siyasat News: “the police had deliberately ignored the court order as the timely medical could have revealed that Bhai Sahib (Kulvir Singh Barapind) was treated with third degree torture in police custody”.
It is notable that Bhai Kulvir Singh Barapind was arrested on intervening night of 19 and 20 September, 2012 under sections 107/151 of IPC but he was later booked under Sections 121 (waging war against the state), 121-A (conspiracy to wage war against the state) and 120-B (criminal conspiracy) of the Indian Penal Code, Sections 3/4/5 of the Explosive Act, Section 25 of the Arms Act and under the Unlawful Activity Act, 1967 on September 22, 2012.
He is currently lodged in Maximum Security Jail Nabha.
