Petition decided on political consideration: Advocate Phoolka

Bathinda (May 30, 2011): Noted advocate Harvinder Singh Phoolka on Sunday said that Devinder Singh Bhullar’s mercy petition was decided on the basis of political considerations and legal aspects were not given due weightage.
Speaking to mediapersons in Bathinda Phoolka said that the petition was rejected by the President even as one of the judges in the three-judge Supreme Court bench had acquitted Bhullar while deciding on the conviction. While two judges awarded death sentence to Bhullar, the third one gave him imprisonment, he added.
“There was a conflict on the conviction and quantum of sentence by the Supreme Court. In a case related to Assam, where one of the three judges had differed on the quantum of sentence, the death sentence was commuted to life imprisonment by the President while deciding on the mercy petition, This case was totally ignored while deciding Bhullar’s mercy petition, he said.

Saying that he failed to understand why Bhullar’s petition was rejected, Phoolka added: “There was no major witness against him and he had retracted from his confession that was said to be made before the police. Three Prime Ministers of the country had also recommended that Bhullar’s mercy petition be accepted.”
“The petition has been decided on political considerations and not on legal parameters. It does not falls in the category of rarest of rare,” Phoolka said, while citing a 1984 riots case, where the Supreme Court had commuted one’s death sentence to life imprisonment.
Meanwhile, activists of SAD (Panch Pardhani) and Ek Noor Khalsa Fauj held a press conference in Bathinda and announced that they will launch a movement to seek a revision of Bhullar’s mercy petition. SAD (Panch Pardhani) worker Darshan Singh Jagaramtirath said panchayats in Bathinda, Mansa and Sirsa will pass a resolution to seek a review of the mercy petition.
