New Delhi, India (January 31, 2014): As per information available with the Sikh Siyasat News (SSN), Supreme Court of India (SCI) has stayed the execution of Sikh political prisoner Professor Devender Pal Singh Bhullar. The court stayed his execution while hearing a petition moved by Prof. Devender Pal Singh Bhullar’s wife Bibi Navneet Kaur.
As per information the court has sought report from Institute of Human Behaviour Allied Science (IHBAS). on health condition of Professor Bhullar, who has been undergoing treatment for mental ailments at IHBAS since 2010.
Prof. DPS Bhullar was convicted by a TADA court of Delhi in 2001 in a 1993 blast case on the bases of fractured evidence that was later rejected by presiding judge of three judges bench of SCI, however two other judges of the same bench had confirmed his death sentence.
His commutation plea on the basis of delay in execution was rejected by division bench of SCI headed by Justice Singhvi in April 2012, who had ‘concluded’ that delay in execution is does not form a commutation ground for those convicted under TADA.
In a recent judgement a constitution bench of SCI rejected the ratio of Justice Singhvi’s judgement and declared that inordinate and unexplained delay in execution could be a commutation ground for all convicts, whether convicted under IPC or some special law such as TADA.
Next hearing of Prof. DPS Bhullar’s case is on 19 February, 2014.
