Sumedh Saini on the Run After FIR in Enforced Disappearance Case; Denied Entry in HP

Chandigarh: It is learnt that the Punjab Police have registered a criminal case against former DGP Sumedh Saini in connection with the disappearance of Balwant Singh Multani in 1991.

What is the matter:

Sumedh Saini was the Chandigarh senior superintendent of police in 1991 when Punjab police had picked up Balwant Singh Multani, son of a former IAS officer, along with father and uncle of Prof. Devinderpal Singh Bhullar. Trio were taken to Quadian police station and are never seen thereafter.

Under What Sections the Case is Registered:

FIR number 77/2020 registered at police station Mataur in Sahibzada Ajit Singh Nagat (Mohali) district is registered on May 5, 2020 under sections 364 (kidnapping or abduction in order to murder), 201 (causing disappearance of evidence), 344 (wrongful confinement), 330 (voluntarily causing hurt to exhort confession) and 120-B (criminal conspiracy).

CBI Investigation Had Found ‘Enough Evidence’ Against Saini:

A CBI investigation, ordered by Punjab and Haryana High Court in 2007 had found that there was enough evidence against Sumdh Saini in this case.

2008 CBI FIR Against Sumedh Saini:

After the CBI submitted its report to the High Court an FIR was registered against Sumedh Saini and some other police officers, including Chandigarh’s former SP (Operations) Baldev Singh Saini and SI Harshay Sharma and Jagir Singh, on July 4, 2008.

Saini Petitions SCI:

After registration of FIR Sumedh Saini challenged HC order and CBI investigation in the Supreme Court of India.

Hearings in SCI:

In SCI some judges had recused themselves from hearing the matter and in other cases benches were changed due to objections raised by Sumedh Saini.

SCI Invalidates HC Order Directing CBI Investigation:

At last the matter was heard by a division bench led by Justice B.S. Chauhan which set aside the order of Punjab and Haryana High Court in which the HC had directed CBI to hold an investigation against Sumedh Saini. While invalidating the order, the SCI had accepted Sumedh Saini’s allegations that the order was passed by a judge who was prejudiced against him.

SCI Had Declined to Take Notice of Findings of CBI’s Investigation:

The SCI had failed to take notice of findings of the CBI and even declined to entertain the request of respondent’s lawyer that SCI should take itself notice of three cases of enforced disappearances and murder by men in uniform.

Is Sumedh Saini on the Run Now?

A close analysis of media reports point towards the possibility that Sumedh Saini is on the run now.

Sumedh Saini Tried to Enter Himachal Pradesh, but Denies Entry Sans Curfew Pass:

A report on The Tribune’s May 07, 2020 10:58 AM (IST) notes that Former Punjab DGP Sumedh Singh Saini and two others were denied entry into Himachal Pradesh from Swarghat area in Bilaspur district on Thursday (May 7) at 4 am.

The report says that Bilaspur SP Divakar Sharma told The Tribune that the former Punjab DGP called him after the policemen posted at Swarghat border denied him entry as he did not have a valid pass. He wanted to visit Karsog.

Did Saini Attempt to Free Punjab/Chandigarh:

There are quite high chances that Sumedh Saini was caught at HP’s Swarghat check post in his attempt to free Chandigarh/Punjab because Swarghat is situated between Punjab/Chandigarh to Karsog.

Where is Sumedh Saini Now?

A report updated on Hindustan Times (HT)’s website on May 07, 2020 at 13:45 IST that Sumedh Saini is said to be in Delhi.

The journalist had mentioned this information along with Sumedh Saini’s quote in response to the registration of case. The information however could not be taken as verified because most likely Sumedh Saini had himself told the journalist that he was in Delhi.

All this points towards the possibility of Sumedh Saini being on the run after registration of case against him.
