Defamation case against Jagdish Tytler: Delhi HC stalls trial; Matter deferred till August 28

New Delhi: The Delhi High Court yesterday (March 24) stalled a trial court from taking any decision in the defamation case against Congress leader Jagdish Tytler. The case was started on the complaint of complaint of senior advocate H.S. Phoolka, who is now a senior leader of the Aam Aadmi Party (AAP).

The High court judge Justice Sunil Gaur’s restrain order came on a plea moved by Jagdish Tytler. In his plea Jagdish Tytler had challenged the trial court’s  order framing charges against him for defamation of HS Phoolka during a TV show in 2004.

Jagdish Tytler has raised a technical issue in his plea before the Delhi High court. He told the court that the trial court had framed charges in the defamation case on the basis of a video cassette obtained from a private TV channel, which was not certified as mandated under the Indian Evidence Act and various Supreme Court rulings.

Taking up the plea of Jagdish Tytler, Justice Sunil Gaur also issued notice to HS Phoolka to file his response on petition moved by Jagdish Tytler. The High Court has fixed August 28 as next date of hearing in this matter.

In his complaint moved in 2006, advocate HS Poolka had maintained that the Congress leader had made derogatory remarks against him in a news programme aired on September 7, 2004.
